This WATCHDOG INFORMATION PORTAL is designed to provide links to information the Mainstream Media is currently BLACKING OUT, DISTORTING, or IGNORING. It is for us "Common Citizens" of the United States who simply want to become a "Well-Informed Electorate."

WIP 03.

The Federal Judiciary as a Weapon Against the Interests of the People of the United States

This portal provides links to some of the MORE THAN 200 legal foundations and lobbying organizations set up and funded by right wing and tax-exempt foundations or corporate interests in the last twenty years. Because they have not been systematically covered by the Mainstream Media over the past twenty years, they have been highly successful in NULLIFYING environmental laws, conservation laws, and other community laws aimed at protecting our society. In addition they are having a growing success in countering affirmative action programs and sexual harassment laws.

In order to protect our society from a well-organized and well-funded NULLIFICATION effort, it is necessary to know who these organizations are, to identify their goals, and to evaluate their past successes and failures. It is possible to do some of this by examining their websites and by reading their own words. Consequently, there are several links to the websites of the lobbying groups and legal foundations.

Due to the BLACKING OUT of news coverage on the NULLIFICATION group, there are only a FEW links to newspaper articles describing the specific activities of some of these foundations.

The material on the Anti-NULLIFICATION effort is equally lacking. Included here are links to articles describing the NULLICATION MOVEMENT's umbrella organizations and funders. One is a link to the NEA report on the Anatomy of the Far Right and a second is a link to an organization opposed to The Takings Project -- the abuse of our judicial system to nullify protective regulation.

The criticism of the over-regulation of everyday life in our country is, in a number of cases, well justified. But we need to sort out the justifiable cases of concern from those instances where powerful private interests are doing damage to our society. Many of the NULLIFICATION groups claim to oppose the taking of private property by local, state or regional governments or by the national government. Yet of many of the same groups can be found supporting industries who are aimed at converting public property or public resources into private profit. The unjustified taking of private property by government is wrong even though a few property owners may be affected in this way. But when the shoe is on the other foot, and public property or resources is taken unjustifiably by the few, the wrong is much greater because the rights of the all of the citizens of the United States are being violated.

The criticism of affirmative action programs and sexual harassment laws is a good thing if these criticisms allow us to correct some of the mis-guided extreme applications or the overreaching abuses observed in both cases. However, the NULLIFICATION groups do not want to fix affirmative action or to limit the misuse of sexual harassment laws, they wish to destroy both.

What is Missing. . . .

We need fair and objective reporting on each of these organizations so that we, as common American citizens, can determine their beliefs and their goals. Some of these we might agree with; others, in my view, are highly dangerous to the political and legal rights of the American people.

The Federalist Society in particular, needs to be explained to the American people. Who funds it? Which side of legal cases do Federalist members support? Who are the judges in this country who belong to the Federalist Society? Who are the law professors and lawyers who belong to the Society? What impact is the Federalist Society having on the laws of the United States? How many members of Congress belong to the Federalist Society?

All of these questions and more can be answered without attacking the Society for its views and goals and without protecting the Society for the same reasons. There are place-holders in the Federalist Society section and the other sections for three kinds of articles:

1. Fair and objective articles

2. Anti-whatever articles

3. Pro-whatever articles

We need understand what is happening, and we need to get a dialog going between the American people and these interest groups.
